By registering to participate in topUNDIT, governed by these terms and conditions and the rules of the Game (as defined below) ("the Game"), you hereby agree to be bound by and to abide by the following terms and conditions.
All applications to participate in the Game must be made online, by WAP, by SMS or via your league manager at www.toppundit.com ("the Site") and strictly in accordance with the relevant instructions.
Entry into the Game is open to both UK and non-UK residents aged 18 years or over.
After subscription, the sole consideration required from an entrant to the Game and/or Player is that the entrant agrees to be bound by these terms and conditions and by the Rules of the Game as defined below at clause 6.
No responsibility can be accepted for lost, delayed or incomplete entries or entries not received by topPUNDIT for any reason. Any such entries will be deemed void (concerning which the decision of topPUNDIT shall be final).
topPUNDIT is governed by the Rules of the Game which are posted on the website. topPUNDIT reserves the right to alter, amend or supplement the Game Rules from time to time as it sees fit in its absolute discretion in the event of any circumstances beyond its control arising or where it considers it desirable to do so and you hereby agree that no liability shall attach to topPUNDIT as a result of any such amendment. You are advised to check the Rules of the Game from time to time. The Rules of the Game form part of these terms and conditions.
topPUNDIT will be the sole arbiter of any matter of interpretation of the Game Rules and any aspect of the content of or playing of the Game. topPUNDIT will not enter into correspondence relating to such matters and its decision as to any matter arising out of or in connection with the Game Rules including but not limited to the allocation of points to any Player and/or the award of any prize and/or any ranking or league table shall be final and conclusive.
Whilst there is no closing date for entries, topPUNDIT will publish from time to time deadlines by which applicants must have registered as Players in order to qualify for points awarded in respect of any round of games in the competition. Any such information on how and when to enter for the Game forms part of these terms and conditions.
Generally, topPUNDIT does not offer prizes. In exceptional cases, the prizes awarded in respect of the Game ("Prizes") will be at the discretion of topPUNDIT, and topPUNDIT reserves the right to alter and amend the Prizes where circumstances beyond its control require it to do so.
Any prizes are not transferable and are non-exchangeable and no cash alternative will be offered in any circumstances.
topPUNDIT reserves the right to reject Player names or Mini-League names which are deemed to be inappropriate, offensive or confusing. Any names so rejected may be changed within 7 seven days. In the event that the alternative name proposed on behalf of any applicant to play the Game in such circumstances is again rejected at topPUNDIT's discretion the relevant applicant will be treated as being in breach of these terms and conditions.
Any and all material posted to any message boards or otherwise published in any form or medium including but not limited to on the websitite by way of registration of details or otherwise on any website of any nature relating to or in connection with the Game which is in any way in the opinion of topPUNDIT offensive, inappropriate, defamatory or likely to bring the Game, topPUNDIT or any member club of topPUNDIT into disrepute shall constitute a breach of these terms and conditions by any person posting or displaying or otherwise publishing the same. All Players warrant to topPUNDIT that no material infringing this clause shall be so posted and/or published in any circumstance.
Any breach by any Player of the Game Rules from time to time shall be a breach of these terms and conditions.
In the event of any breach by any applicant and/or any Player of these terms and conditions topPUNDIT reserves the right to refuse entry to the relevant applicant and/or disqualify the Player in question from any further participation in the Game and such decision by topPUNDIT shall be final. Any applicant so refused and/or Player so disqualified shall not be eligible to participate in the Game under any other identity or team name.
Registration of details of any Player and/or any Mini-League in connection with the Game (as opposed to the mere registration of the Player as a user of the Site independent of the Game) shall constitute irrevocable and unconditional consent by the Player concerned to the publication of all such details in connection with the Game on the Site and on any other website used in connection with the Game in a manner which is accessible to all Players of the Game and/or visitors to the relevant Site or website in each case as topPUNDIT sees fit.
Winners will be notified of their success by email in respect to any prizes that may be offered.
The winners' names will also be published on the website.
topPUNDIT is not liable for any loss or damage whatsoever which is suffered by any person (including but not limited to indirect or consequential loss) as a result of or in connection with or arising out of the Game and/or the application of the Rules of the Game or these terms and conditions or as a result of or in connection with or arising out of any Prize or the use of the same or any personal injury suffered or sustained as a result of or in connection with or arising out of any Prize or the use of the same except for any liability which cannot be excluded by law.
topPUNDIT will do everything in its power to maintain a continuous service for it's players. However, topPUNDIT cannot be held responsible for any technical failures which may arise, regardless of the source of the failure.
Players' names and addresses and the winners' photographic images and their comments relating to any Prize may be used without limitation for future promotional, marketing and publicity purposes of topPUNDIT in any and all media worldwide without notice to them and without any fee being paid.
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
